Worthy Asks For Kilpatrick Information

DETROIT (WXYZ) - Wayne County Prosecutor Kym Worthy's office has filed a motion asking for information about Former Detroit Mayor Kwame Kilpatrick's finances.

The Motion for Discovery was filed this morning. It will be heard in Judge David Groner's court at 2:00 p.m. on October 5. Worthy's office filed the motion ahead of an October 28 Restitution Hearing. Kilpatrick will not have to appear on October 5. He will have to appear October 28.

Worthy's office asked for the hearing last week, accusing Kilpatrick of eight separate violations of his probation. Today's motion is part of the discovery process.

In today's motion, Worthy's office is asking for a complete, itemized accounting of all gross income for Kilpatrick and all of his immediate family members. She also wants all financial statements outlining any and all assets Kilpatrick and his wife have.

The motion also asks for any and all gifts over $100 dollars Kwame and Carlita Kilpatrick have received, as well as all bank and other account in their names, and the couple's tax returns for the last two years.

Worthy's actions came after Kilpatrick came up short on his September restitution payment. He also paid it late.

Kilpatrick paid $3,000 instead of the $6,000 he is supposed to pay each month. Sources tell Action News that Kilpatrick says he does not have the money to pay.

Kilpatrick was allowed to leave Michigan to work in Texas, but Prosecutor Worthy says he has not lived up to his obligation.

Some of the other violations he's accused of include; failing to declare all of his assets and failing to declare his wife's assets.

"It is our position that he has violated his probation," said Prosecutor Worthy. "We have seen no proof that his salary has diminished and we have been asking Judge Groner for a restitution hearing for months."

Kilpatrick was ordered to pay $1 million in restitution after he was convicted in the text messaging scandal.

Text messages showed that Kilpatrick and his former chief of staff Christine Beatty lied under oath during a 2007 police whistle-blower lawsuit trial.
