(WXYZ) - A California woman is nearly $10,000 richer after suing Honda in small claims court, because her 2006 Honda Civic Hybrid never got the fuel economy that the company promised.
Heather Peters sued because her Civic Hybrid never got more than 30 miles per gallon, while the company pledged that it would get up to 50 mpg, in city driving.
Honda is trying to settle a major class action lawsuit for the same claims by paying drivers up to $200 and offering a $1000 credit on a new car.
The California judge awarded Peters $9,867 in small claims court. The judge, Douglas Carnahan, found that Honda did not commit fraud, but ruled that the company was aware "there were problems living up to its advertised mileage".
By suing in small claims, Peters didn't have to have an attorney. Peters told reporters, in California, that she is hoping others will also file individual small claims suits.
Peters calls the ruling "A victory for Honda Civic owners everywhere".
