DETROIT (WXYZ) - A 9-year-old who has been in the care of Child Protective Services since being involved in what police are calling an accidental shooting has been returned to his family.

The incident happened on Saturday, February 4 on the 12800 block of Kilbourne in Detroit.

According to police, the victim, a 15-year-old African American boy, was walking down Kilbourne in the evening when he saw the 9-year-old male suspect on a front porch.

Police say that the time of the incident the 9-year-old was in the care of his 16-year-old sister while their mother was running an errand.

The boy was playing in the yard where he found the loaded handgun. He was playing on the porch with the gun when it went off, hitting the 15-year-old.

The victim was taken to a nearby hospital and at that time, listed in temporary serious condition.

Police recovered the weapon.

Detroit Police say they have spoken with the boy and witnesses. Based on their findings, no criminal charges will be filed in the case.
