(WXYZ) - As Kwame Kilpatrick's book hit shelves Monday, his lawyers went to court to request Kilpatrick be able to keep the proceeds.
In June, Judge David Groner ruled that all proceeds of Kilpatricks tell-all memoir entitled “Surrendered! The Rise, Fall and Revelation of Kwame Kilpatrick,” be used to pay off the roughly $860,000 in restitution he owes to the city.
Monday morning Kilpatrick's attorney Dan Hajji, argued that the judge should not have made a summary judgment regarding the proceeds but that any decision should have been made after a trial. Hajji has argued that Michigan's Son of Sam law that forbids criminals from profiting from their misdeeds is unconstitutional.
The judge will make a decision August 17.
Meanwhile, the Department of Corrections wants Kilpatrick to pay the cost of his incarceration; $119,090.
Monday, the State Attorney General's office put in the request and a hearing is scheduled for Wednesday. The judge is scheduled to also make this decision August 17.
