(WXYZ) - On the second day of his disciplinary hearings brought by the Judicial Tenure Commission, Judge Wade McCree said he "lusted after" a complaining witness who appeared before him in a child support hearing.
"I'll admit, I was attracted to her," he said, referring to Geniene La'Shay Mott.
"I’m a middle aged man, she’s an attractive younger woman...I was excited."
McCree acknowledged that his affair with a witness was inappropriate and that he should have recused himself as soon as possible. Instead, it took him months to pass the case off to another judge.
Earlier in the day, McCree's wife Laverne took the stand in his defense. Laverne McCree, who's been married to the judge for 25 years, described the night Geniene La'Shay Mott came to her family's home, demanding to see her husband.
"She was pounding on the door," said Mrs. McCree.
"My son was...asking: 'Was someone breaking in?' I told him I didn’t think that was happening," she said.
Mott is at the center of this week’s disciplinary hearings, where McCree is accused of gross misconduct.
For two hours, Mrs. McCree testified calmly and evenly and helped paint Mott as an extortionist who threatened to tell the press about their affair if McCree broke it off. Mrs. McCree said that Mott demanded the couple pay for her abortion, but there were strings attached.
"Miss Mott was, in my opinion, extorting," McCree's wife, said.
"(She agreed to) get an abortion if Wade provided a proof of service that he was getting divorced. He provided a proof of service that we would go through these hurdles...then she changed her mind."
Mrs. McCree said the couple never seriously considered getting divorced, but under cross-examination by JTC lawyers, she admitted it was something they thought about.
State lawyers tried to show that McCree’s wife’s testimony was inconsistent, and had her read an e-mail that her husband had sent to her mistress last year.
"I’m in a marriage of convenience," Judge McCree wrote Mott.
"My wife and I haven’t had intimacy, we share a mortgage, two kids and investments. There have been times when we considered dissolving our marriage. But for whatever reason, we did not."
Judge McCree described Mott as volatile, and said she threatened him when he refused to spend more time with her.
"Her threat was, 'I’ll tell your wife,' " he said.
McCree’s affair with Mott took place while she was complaining that the father of her child was behind in child support payments. McCree has maintained that, even though he oversaw that case, his affair didn’t impact his judgment. Today, his defense team called the lawyer for the father of Mott’s child, Fredrick J. smith, who said the case was handled fairly.
"It did not appear to be unusual," Smith said.
