DETROIT (WXYZ) - Kwame Kilpatrick's attorney, Jim Thomas, says his client should be let out of prison because he is not receiving treatment after re-injuring his knee.
Thomas made the argument in a court filing in response to an argument by federal prosecutors that Kilpatrick should remain behind bars until his sentencing, which has not yet been scheduled.
Kilpatrick is also asking to be released so that he can see his family in Texas.
In his filing Thomas says Kilpatrick is not receiving treatment in a timely manner.
A federal judge ordered that both Kilpatrick and Bobby Ferguson would be held at the Milan Detention Center until they are sentenced on federal corruption charges.
Family members of both men have offered to put up homes as collateral if they are released on bond. However, prosecutors argue that both men are flight risks.
Thomas's response came late Tuesday after US District Court Judge Nancy Edmunds gave attorneys for Ferguson and Kilpatrick until the end of the day today to make their final responses in the arguments over bond.
At last check Ferguson's attorney had not yet filed a response on behalf of his client.
