Witness testifies, feds suggest document was altered in Kilpatrick corruption trial

DETROIT (WXYZ) - 7 Action News provided updates as court resumed in the Kilpatrick Corruption Trial on Wednesday.

1:00 p.m.

Court ends for the day.

12:23 p.m.

The judge just announced that a few jurors have been bitten by jumping and/or flying bugs.  Court services have sprayed the jury box recently, but the judge wants to know if anyone else in the courtroom has been bitten.

12:08 p.m.

Federal prosecutors are showing the jury text messages that were sent between Kilpatrick and Ferguson about Jones contacting former Congresswoman Carolyn Cheeks Kilpatrick.  Jones has been testifying about how he kept hearing that he had to resolve his "issues" with Ferguson in order to get more city work.  Jones said he was unaware that he had "issues" with Ferguson and met with Kilpatrick at the Manoogian Mansion to assure the mayor of his loyalty.
Here's the text exchange between Ferguson and Kilpatrick from November 2004:
Ferguson: Odell Jones call you moma lol
Kilpatrick: I know. And my sister.
Ferguson: Ok I thought it was funny, should have followed my first mind I know he wasn't shit
Kilpatrick: Yep

11:45 p.m.

Jones is testifying about violations they received from MDEQ inspectors. He said he met with Ferguson about how Ferguson's workers were performing asbestos removal without proper protective gear.  Jones said Ferguson didn't really seem to care, and said Ferguson told him:  "I had turned into a punk and a puppet for the white man."

Jones says Ferguson also said he would get the mayor to call the governor about the MDEQ violations, and Jones told him that not all construction disputes were political.

11:36 a.m.

Now on the stand: Odell Jones, former owner of Jomar Costruction, which worked on the Book Cadillac Hotel. Jones is telling the jury about a fee dispute he had Ferguson on a previous Detroit Public Schools project, and now he's talking about alleged violations Ferguson's tradespeople received while they were doing "selective demolition" for the hotel renovation.

10:03 a.m.

Defense lawyers got Agent Paszkiewicz to admit that she's not a document expert nor is she an expert in authenticity.
Now the feds are questioning someone from Inland Waters Pollution Control who continues to back up the feds claims that Ferguson seems to have altered a document.
More records are being shown the jury that Ferguson wasn't on the scene of the 2004 Sterling Heights sinkhole until about 3 weeks after the defense suggested that he was there.
The feds are trying to discredit Ferguson with the jury.

9:32 a.m.

Agent Paszkiewicz is showing the jury different work records from the Sterling Heights sinkhole collapse.

Paszkiewicz is showing a record that matches something the defense admitted into evidence - a record dated 8/23/04. Paszkiewicz  is saying the actual document was dated 3/24/04, suggesting to the jury that the defense exhibit has been altered. 

At issue is when Ferguson was working on the scene of the 2004 sinkhole, and whether he allegedly used his relationship with former Mayor Kwame Kilpatrick to get work at the site.

9:07 a.m.

Court is about to resume for the 55th day of the Kilpatrick Corruption Trial.  EPA Special Agent Carol Paszkiewicz is up first on the stand. It's expected that she will resume her testimony about a suspicious document. 

As court broke yesterday, Agent Paszkiewicz was discussing a document that allegedly indicates that Bobby Ferguson was on the scene of a major sinkhole collapse in Sterling Heights. 

Agent Paszkiewicz  started to suggest to the jury that she "had concerns" about the document. 

Federal prosecutors seemed to be suggesting to the jury that the record was altered. The lawyers are all currently meeting with the judge before Agent Paszkiewicz resumes her testimony.
