Troy going to court over mayor controversy

TROY, Mich. (WXYZ) - A motion hearing will be held today in the Troy mayor controversy.

The Secretary of State's Office filed a lawsuit against the City of Troy because of the way the vacant mayor's position was filled.

The previous mayor, Janice Daniels, was recalled by voters last month.

City Council appointed Dane Slater to fill the position until the next election in November 2013.

Leaders say they were acting according to the City Charter, but the Secretary of State says state law requires Troy to hold a special election in February and let voters decide who should fill the vacant mayor's position.

The city has refused and will now have to explain itself in court Tuesday.

The hearing begins at 10 a.m.
