Snyder appoints Macomb County Chief Judge David Viviano to replace Diane Hathaway

LANSING (WXYZ) - Gov. Rick Snyder appointed Macomb County Chief Judge David Viviano to the State Supreme Court Wednesday.

Viviano replaces former Justice Diane Hathaway, who pleaded to bank fraud last month following a 7 Action News Investigation that exposed how she shuffled properties out of her name to qualify for a short sale. It allowed her to escape from $600,000 in mortgage debt.

Viviano has been on the bench since 2006.  In 2004, he ran for Macomb County prosecutor as a Republican, but was unsuccessful.  His appointment will give Republicans a 5-2 majority on the Supreme Court.

Judge David F. Viviano is "a man of unimpeachable integrity, an exceptional trial judge and a recognized leader on the bench," said Chief Justice Robert P. Young, Jr Wednesday.

State campaign records indicate that Viviano has donated primarily to Republican candidates. Ironically, though, he did donate $100 to the campaign of Dana Hathaway--whose mother he replaces--in her successful run for Wayne County Circuit Court.
