Taylor father accused of killing infant daughter admits to "big mistake"

As the father of six-week-old Payton Smolen appeared in court, one investigator described the baby's death as "heinous" and "deliberate".
 
On Tuesday, Luis Marcos Smolen, 23, was arraigned on charges of First Degree Murder and First Degree Child Abuse. Smolen told the judge he made a "big mistake".
 
Investigators say they were called to the Smolen's home on the 15450 block of Park Village in Taylor Saturday around 9:40 a.m. on a report of a baby not breathing.
 
We're told it was at the hospital where head trauma and injuries to the baby's body were discovered.
 
Details about what Smolen may have told investigators could be revealed at his preliminary examination on December 16.
 
Smolen is being held without bond.
 
In November, Smolen was charged with Assault with Intent to do Great Bodily Harm in a separate case.
