Former Macomb County prosecutor to appear for plea hearing Wednesday

(WXYZ) — Months after being arraigned in federal court on a charge of obstruction of justice, former Macomb County Prosecutor Eric Smith will appear before a judge on Jan. 27 for a plea hearing.

The hearing was postponed in November 2020 after Smith tested positive for the coronavirus. He was admitted to a local hospital with severe symptoms and treated, then released.

In September 2020, 7 Action News reported that Smith signed a plea deal with the feds for a sentence recommendation of one to two years. His charge could come with a sentence of up to 20 years in prison.

Smith faces additional charges and ten counts, including embezzlement and racketeering following a raid at his home and office.

It is alleged that Smith and three others stole $600,000 from forfeiture funds collected in drug and drunk driving cases.

Smith will appear in front of District Judge Linda V. Parker via Zoom at 11 a.m. on Wednesday.
