(WXYZ) - Former Detroit Mayor Kwame Kilpatrick says he is not a flight risk because of a knee injury that requires surgery, and wants out of prison, according to a new filing with the U.S. Court of Appeals.
The injury happened on the same day a jury convicted Kilpatrick in March of racketeering and other charges. U.S. District Court Judge Nancy Edmunds, who presided over his trial, has repeatedly denied Kilpatrick's requests to be let out of prison while he awaits sentencing.
However, his new court-appointed attorney Harold Gurewitz appealed Edmunds's rulings and argues that Kilpatrick should be let out of prison to have knee surgery. Gurewitz cited a letter from Kilpatrick's physician, who also says Kilpatrick will need physical therapy following surgery, and possibly a walker. He asked that the doctor's letter remain under seal because this is a high-profile case and wants to protect the doctor-patient relationship.
Kilpatrick's sentencing date has not been scheduled.
