TROY, Mich. (WXYZ) — A 29-year-old Auburn Hills man was arrested for driving under the influence with a small child in the car.

Troy police say that officers responded to a report of a man driving on the closed section of northbound I-75 at the Rochester Road exit ramp. The driver was directed off the closed freeway by construction workers.

Police say the man admitted to not having a driver's license.

One officer observed a 4-year-old child asleep in the backseat. Police say the child was not seat belted nor in a car seat.

The officer noted an odor of marijuana from inside the vehicle and an odor of alcohol emanating from the driver. Police say the driver was asked to perform several sobriety evaluations, but performed poorly.

His Preliminary Breath Test result was 0.164%.

The driver was arrested and charged with Operating a Motor Vehicle While Under the Influence of Alcohol, No License, Driving While License Expired and Child Endangerment.

Police say the child has been turned over to the custody of his grandmother.
