Eastpointe man shot by 91-year-old charged with felonious assault

The man who was shot by a 91-year-old in Eastpointe on Monday has been charged with felonious assault.

According to police, 30-year-old Richard Ashford walked up to the man in a threatening manner in a Rite Aid parking lot around 10:15 a.m. Monday.

The elderly man, frightened by the approach, said he was a CPL holder and went back to his car. He waited until Ashford walked out of view.

Then, the elderly man got out of his car and started walking to the store.That's when Ashford approached him again. The man then said he was armed and Ashford took off.

Police say the suspect again came back, holding an unknown object above his head. That's when police say the elderly man pulled out his .38 revolver, shot at the suspect twice, hitting him once in the neck.

“This elderly man’s self-defense is an entirely appropriate use of force,” Prosecutor Eric Smith said. “Facing imminent assault, he announced that he was armed, made attempts to withdraw, warned again that he held a weapon, and fired only when completely necessary."
