Metro Detroit woman suing Every Time I Die over broken neck at concert

Tonya Ross bought VIP tickets as a birthday present for her daughter to go to a punk rock concert at the Crofoot in Pontiac on August 13. 

As the band Every Time I Die was playing some people in the audience were crowd surfing, and guitar player Jordan Buckley apparently wanted to join in. 

According to the lawsuit he jumped from the stage and landed on Tonya Ross.  S

he tells 7 Investigator Jim Kiertzner she never saw it coming, “I got knocked out when my head hits the cement.” 

In her lawsuit she claims she suffered a catastrophic injury, a brain injury, a broken neck and a concussion.

“I have migraines every day which is why I have sunglasses on. I can’t handle light. I can’t handle sound. My daughter has a choir concert and I can’t attend it,” she says.

The lawsuit was just filed in Federal Court in Detroit and does not specify damages. 

Plaintiff Attorney Tyler Joseph also tells 7 Investigator Kiertzner, “Nobody expects flying bodies from above and suffering these kinds of damages simply by going to a concert trying to enjoy themselves.” 

We reached out to management for the band Every Time I Die and have not heard back.
