The family of a man shot and killed by Dearborn Police has filed a lawsuit.

The family of Kevin Matthews, 35, filed the $10 million wrongful death lawsuit.

"Kevin was a very special person to our family," said Kimberly Matthews, his sister.

Matthews died December 23 last year in the city of Detroit, just outside of Dearborn.

Dearborn Police say an officer tried to stop him for an outstanding warrant, but he ran.  After a chase there was a struggle and the officer shot Matthews as Matthews tried to take his gun.

Attorney Milt Greenman says an autopsy found Matthews was shot several times more than police first reported and the medical examiner’s autopsy report stated he weighed about 40 pounds more than he did. Greeman says that is suspicious. You can read the attached lawsuit documents.

So far, the Dearborn Police Department has not commented on the suit.
