Woman says worker stole gun from her car at metro Detroit car wash

Southfield Police say they are investigating what happened at the Jax Car Wash in Southfield. 

A woman filed a police report saying she left her gun behind in a car. As a worker at the car wash cleaned it, she claims she saw surveillance video that showed him taking something from the car and hiding it in his pants. 

“I just want my firearm back. That is my protection,” she said. 

She says she asked the owner of Jax to replace her gun. 

“His statement to me was there is a sign up. We are not responsible for anything left in your car,” she said. 

We wanted to know if that sign takes away the business’ liability. 

“No it does not,” said Attorney Cliff Woodards. “There is a little known statute to most of us. It is called the Garage Keepers Liability Act. It is Public Act 256.”

Woodards says under the law when a business has custody, care, or control of your car - they are responsible for it and the contents. 

“So even thought you see that when you park, they’re still liable,” he says. 

Jax owner Bruce Milen says he does not believe the video shows his employee taking anything.  He said he could show 7 Action News the video to prove this, but he did not want to.

He says he believes the gun was stolen by someone unrelated to his business. 

Southfield Police say only that they are investigating.
