It has been more than a year since Wayne County Prosecutor Kym Worthy laid out evidence showing why she would not charge an Immigration and Customs Enforcement officer who shot a man while executing a warrant.
She said the officer acted in self defense.
But that's not stopping the family of that robbery suspect from suing. The attorney for the family says they have filed a suit asking for $50 million in damages.
They plan to hold a press conference today to share details of that suit.
They say 20-year-old Terrance Kellom was unarmed-- and should not have been shot. They claim an ICE agent and Detroit police officers presented no warrants and falsified reports saying that Kellom was armed with a hammer.
However, Worthy said that forensic evidence showed otherwise.
She said it showed the 20-year-old man lunged at the ICE agent with a hammer in his father's west side home.
Worthy says Kellom was shot four times. His death came amid a national debate over police conduct - particularly toward black men. Kellom was black, as is the agent who shot him.
