DPS loses part of suit to stop sick-outs

The Michigan Court of Claims heard a lawsuit Thursday, brought on by DPS, seeking an injunction in an effort to stop the repeated teacher sick-outs that have led to canceled classes.

Educators have been protesting deplorable conditions among other things.

The district claims the sick-outs were orchestrated by the teachers' union and several key individuals. They argued this violates the terms of the union contract.

The judge however, called the actions of the union, first amendment rights, ruling against DPS on that portion of the suit.

Another portion, in which those key individuals are named, will be heard on March 7th.

The lawsuit named 28 defendants, including DFT Interim President Ivy Bailey, former DFT president Steve Conn and numerous teachers.

DPS issued this statement today:

"The District is disappointed in the Judge's decision to dismiss the DFT. However, we look forward to being able to prove our allegations against the perpetrators of the wildcat strikes that have taken 12 days of instruction away from the more than 46,000 students of Detroit Public Schools."
