Michigan Supreme Court to decide on drunk driving in our own driveways

The Michigan Supreme Court heard arguments in an Oakland County case that will determine if we can be charged with drunk driving in our own driveway.

The Oakland County Prosecutor charged Gino Rea in 2014 and his case was tossed out by an Oakland County Judge and by the State Court of Appeals. 

Assistant Oakland County Prosecutor Marilyn Day argued this case should be easy to decide, because the way the Michigan Legislature wrote the law.   

However, legislative intent was also argued by Camilla Barkovic, representing Rea. 

Northville Police were answering a call for loud music when they found Rea backing out of his garage, then he drove back in. 

A ruling is expected later this year.
