State Senator Virgil Smith will be resigning his senate seat by the end of the week.
That’s according to smith's attorney, Godfrey Dillard.
Smith was sentenced to ten months in jail as part of a plea to malicious destruction of property, along with five years' probation.
He was accused of shooting his ex- wife's car.
