Suspect takes the stand in judge shooting trial

The trial for the man accused of shooting Federal Judge Terrence Berg continues.

Kevin Smith, 23, is accused of shooting Berg outside his Detroit home in March of last year.

Police say Smith and another man approached Berg and demanded access to his home. When he refused, police say, Smith shot Berg. 

Berg told the jury Smith's eyes looked similar to the man who pulled the trigger, but he couldn't positively identify him as the gunman.

On Thursday afternoon, the prosecution rested its case. Smith's attorney is asking for a charge of assault with intent to do great bodily harm less than murder, not the current charge of assault with intent to murder among other felonies.

Also, Smith took the stand in his own defense on Thursday afternoon as the defense started mapping out its case.
