(WXYZ) — The Republican National Committee and Michigan Republican Party are suing Secretary of State Jocelyn Benson and Attorney General Dana Nessel after a state judge ruled that ballots received after Nov. 3 but postmarked by Nov. 2 could be counted.
Judge Cynthia Stephens ruled that absentee ballots postmarked by Nov. 2 and received within two weeks of the election are allowed to be counted.
In the ruling, Stephens also said that a voter can have anyone help them return their ballots between the Friday before Election Day and on the Nov. 3 Election Day.
“The evidence in this case stands uncontroverted and establishes that the mail system is currently fraught with delays and uncertainty in light of the COVID-19 pandemic,” Stephens said.
In the lawsuit, both parties are asking Stephens to uphold the constitutionality of the ruling.
