(WXYZ) - The ex-wife of rap superstar Eminem, Kim Mathers, appeared in Macomb County District Court this morning.
The 41-year-old mother of two was accused of violating probation because of multiple diluted drug test results.
On Monday, the judge said diluted results can be accidental and he's impressed Mathers proactively switched to Soberlink which randomly administers tests daily.
This all stems from a drunk driving accident in 2015 in which court documents reveal Mathers admitted to police she drank a fifth of rum on purpose before getting behind the wheel in a suicide attempt.
Before a judge in November 2016, Mathers apologized and expressed remorse. She reached out for help and began counseling before it was mandated by the court.
The judge sentenced Mathers to 12 months of probation in which she is to continue counseling, submit to regular drug tests and random alcohol testing.
Court documents show six of her drug test results were diluted from December 2016 to February 1, 2017, including back to back days in January.
In court on Monday, Mathers' defense attorney told the judge his client didn't over-hydrate intentionally. He says there is no education on that aspect of drug testing so clients often don't know they are diluted until they receive a notice.
When Mathers received the notice she immediately voluntarily submitted hair and blood samples then requested testing through Soberlink. A device that tests multiple random times every day. Much more rigorous and thorough than Mathers is required to submit by the courts.
Her attorney says 197 Soberlink tests have all come back negative as well as a hair sample test.
"I did nothing wrong. I went above and beyond to prove to the court I'm compliant and that I take the judges orders seriously. I just want to move on," Kim Mathers told 7 Action News.
Judge Douglas Shepard said he was impressed with her pro-active voluntary actions to prove her compliance. She will continue serving her probation.
