Questions are being raised about a low bond set for a man charged with two counts of Criminal Sexual Conduct involving a child under 13-years-old, after he allegedly attack again.
Forty-four-year-old James Beck of Chesterfield Township Ii charged with a rape of a 12-year-old girl in his home on February 12th.
Court records show he was out on a bond of only $2,500 - which was 10% cash surety of $25,000 and it included no contact with kids.
Macomb County Circuit Court Judge Jenifer Faunce, who records show set that bond in the first case back on January 26, 2016, was not in her office to explain her ruling.
The bond was revoked when the new charge was issued this month.
In the new case, a discussion over a new bond became heated between District Judge William Hackel, III and Assistant Macomb County Prosecutor Suzanne Shkreli.
She argued something could cause the bond revocation to be reversed. The judge said she could come back into his court then.
The Macomb County Prosecutor Chief Trial Attorney Jean Cloud would not criticize Judge Faunce in her bond ruling and could not say if this is uncommon.
She said they ask for high bonds to protect the community, but the decision is up to the judge.
Beck is being held in the Macomb County Jail. He faces 25 year to life if convicted.
